Is Weed Legal in Georgia?

Georgia is one of the original 13 Colonies and has always been at the forefront of U.S. history, but is weed legal in Georgia? Sadly, marijuana legalization is one area where the Peach State has yet to catch on.

But Georgia weed laws do include exceptions in the form of its confusing and unwieldy medical marijuana program. And that’s about the only area where cannabis marketing and products are permitted.

If you’re living in Georgia and are wondering where your state stands on the green issue, here’s what you need to know.

The Straight Answer – Is Weed Legal in Georgia?

As of summer 2023, 23 states have legalized marijuana for recreational purposes, but Georgia isn’t one of them. In fact, Georgia has the strictest marijuana regime in the country, apart from five states that still prohibit medical marijuana.

With no signs of recreational marijuana legalization, this deeply divided Southern state continues to follow federal direction regarding weed.

Under Georgia marijuana laws, you could still face significant financial penalties and even jail time. Currently, the penalty for illegal possession of one ounce of marijuana is up to a year in prison and a $1,000 fine.

Marijuana Ordinances in Georgia

Is weed legal in Georgia under any circumstances other than medical? Technically, no, but separate weed ordinances in certain municipalities run contrary to overarching state and federal laws.

Most ordinances have decriminalized marijuana possession and the associated jail time. For example, Savannah issues $150 citations for misdemeanor marijuana possession, whereas Athens has citations of just $35.

So, it might not be legal, but there’s little to be worried about over conventional possession if you live in the following Georgia municipalities:

·                Chamblee

·                Statesboro

·                Macon-Bibb

·                Tybee Island

·                Kingsland

·                Forest Park

·                South Fulton

Of course, this soft-touch regime won’t apply if you’ve got an entire zip of weed or you’re selling out of your trunk. These penalties are for misdemeanor possession only.

Are Any THC Products Legal in Georgia?

Georgia cannabis laws state that you can be charged with possessing a Schedule I narcotic if you possess THC products with more than 0.3% THC derived from non-hemp sources. That aligns with the 2018 Farm Bill passed under President Donald Trump.

Note that CBD products fall under a separate set of regulations. Whether something is illegal mainly depends on its THC content and where the THC came from.

Does Georgia Have a Medicinal Weed Program?

Is weed legal in Georgia for medicinal purposes? Yes, but this is one of the strictest programs in the country.

You won’t find any traditional dispensaries or weed delivery services in Georgia. Even if you qualify medically, you can only possess up to 20 fluid ounces of low-strength THC oil. Physicians are still banned from prescribing medical weed.

If you are from another state, you can still qualify for an MMJ card, but there’s no automatic reciprocity with any other state. Additionally, you must obey Georgia’s marijuana laws, meaning that low-THC oil will still be your only legal weed option.

Can You Smoke Weed in Public in Georgia?

No, marijuana smoking and possession in public is completely prohibited. However, if you’re living in a municipality where simple possession has been decriminalized, you might get off with a fine.

Note that even with decriminalization, issuing a citation is entirely at the officer’s discretion. If it isn’t the first time you’ve been caught with weed, or you make a big deal out of it, you still might find yourself in a courtroom.

Moreover, penalties can be more stringent depending on where you were caught with marijuana. For example, there’s a big difference between being caught with weed outside of an elementary school and your neighbor complaining about the smell in your backyard.

What Strains of Weed are Legal in Georgia?

No marijuana strain is legal in Georgia, even if you have a genuine medical need. The Peach State has one of the strictest regimes of any state in the union.

This is because medical marijuana legalization didn’t come with the right to buy a weed scale and roll up some of that good stuff.

Under the law, the only way to legally enjoy psychoactive compounds is hemp-derived delta-8 THC products. Since delta-8 THC is legal at the federal level, it’s also permitted in Georgia.

However, delta-8 THC is about 50% of the potency of the delta-9 THC found in the marijuana plant.

When Will Weed Be Legal in Georgia?

Is weed legal in Georgia in the near future? Sadly, Georgia has long lagged behind other states regarding marijuana laws.

The first licensed dispensaries where medical patients could purchase low-THC cannabis oil from cannabis brands only opened in the spring of 2023. It took years to win those concessions, so don’t expect fresh legal herb in the Peach State soon.

Although state-level Democrats have made efforts, it’s widely believed that you won’t enjoy any cannabis tourism in this part of the South until the federal government alters its position on weed.

This is unfortunate because even though we are seeing increasing evidence demonstrating the benefits of marijuana and we’ve proved that youth marijuana use has dropped with legalization, it has made little difference legally.


Marijuana legalization is advancing on all potential fronts. But Georgia remains a relative hotbed of resistance to the new normal.
