With no signs of recreational marijuana legalization, this deeply divided Southern state continues to follow federal direction regarding weed.

Under Georgia marijuana laws, you could still face significant financial penalties and even jail time. Currently, the penalty for illegal possession of one ounce of marijuana is up to a year in prison and a $1,000 fine.

Are Any THC Products Legal in Georgia?

Georgia cannabis laws state that you can be charged with possessing a Schedule I narcotic if you possess THC products with more than 0.3% THC derived from non-hemp sources. That aligns with the 2018 Farm Bill passed under President Donald Trump.

Note that CBD products fall under a separate set of regulations. Whether something is illegal mainly depends on its THC content and where the THC came from.

Does Georgia Have a Medicinal Weed Program?

You won’t find any traditional dispensaries or weed delivery services in Georgia. Even if you qualify medically, you can only possess up to 20 fluid ounces of low-strength THC oil. Physicians are still banned from prescribing medical weed.

This is because medical marijuana legalization didn’t come with the right to buy a weed scale and roll up some of that good stuff.

Under the law, the only way to legally enjoy psychoactive compounds is hemp-derived delta-8 THC products. Since delta-8 THC is legal at the federal level, it’s also permitted in Georgia.

However, delta-8 THC is about 50% of the potency of the delta-9 THC found in the marijuana plant.

When Will Weed Be Legal in Georgia?

Is weed legal in Georgia in the near future? Sadly, Georgia has long lagged behind other states regarding marijuana laws.

The first licensed dispensaries where medical patients could purchase low-THC cannabis oil from cannabis brands only opened in the spring of 2023. It took years to win those concessions, so don’t expect fresh legal herb in the Peach State soon.

Although state-level Democrats have made efforts, it’s widely believed that you won’t enjoy any cannabis tourism in this part of the South until the federal government alters its position on weed.

This is unfortunate because even though we are seeing increasing evidence demonstrating the benefits of marijuana and we’ve proved that youth marijuana use has dropped with legalization, it has made little difference legally.
