However, keep in mind that a “cannabis drink” or “hemp-infused beverage” may not contain significant amounts of THC. CBD and CBG are compounds also found in cannabis plants, so CBD or CBG drinks could fall under the “cannabis” and “hemp-infused” categories too.
Cannabis drinks made with compounds derived from marijuana do exist, but they’re much harder to find due to legal restrictions across the country. So, “marijuana drinks” are not exactly what we’re talking about here. Those are often way more potent, and they are only available in certain states where recreational marijuana is legal, and there are no laws concerning marijuana in drinks.

The final step following the emulsification is just mixing in those cannabis particles with whatever base you choose, which is often a fizzy, flavored seltzer.

In 2018, the U.S. passed a Farm Bill that legalized the production, sale, and use of hemp-derived products which have hemp based THC and not Marijuana based THC. Hemp is a type of cannabis plant that contains 0.3% THC concentration or less. Any cannabis plants with more than 0.3% THC are classified as marijuana plants.
So, 1mg of THC from a hemp plant is federally legal, but 1mg of THC from a marijuana plant is not. This bill allows people across the country to produce THC-infused drinks, so yes, THC drinks are legal. Some local governments have passed laws banning hemp products anyway, but those are few and far between.
